2008 EAST JEFFERSON LEVEE DISTRICT
CONSTRUCTION PERMIT APPLICATION/PROCEDURES

 

I.         An East Jefferson Levee District Construction Permit is required within the following distances:

A.           All work within 300’ of the levee CENTERLINE for both Mississippi River & Tributaries (MR&T) projects and federal hurricane protection projects. (To include, all major additions, such as driveways, decks, pools, etc., new homes, and all other substantial developments/improvements.)

B.           All subsurface work within 1500 feet of a MR&T levee centerline and 300 feet of a hurricane protection levee centerline.  Subsurface work includes excavations (digging), ponds, swimming pool, drainage ditches, soil boring well, shafts, pile driving, etc. 

C.          Seismic surveys and demolition using explosives within 5000 feet of both MR&T and hurricane protection levees and structures.

D.          Do NOT plant vegetation or  place any object or material within the East Jefferson Levee District Right-Of-Way. 

 

II.   Applicant must submit an application to the East Jefferson Levee District furnishing the following information:

A.           Name, Address, and Telephone Number of Applicant.   State if Applicant is an individual, sole proprietorship, partnership, corporation, or limited liability company.  If applicant is a corporation, limited liability company, or a partnership, list principal shareholders, officers, directors, and partners and their addresses.  If applicant is a sole proprietorship, provide owner’s name and address.

B.           Your permit request must include a formal application, a letter of request accompanied by a scope of work, a survey of your property by a Professional Land Surveyor showing the levee right of way line and any and all servitudes, full size construction drawings and pertinent specifications of all work that is to be done relative to excavation, pile driving or drilling.  Drawings are to be to scale and must include the following information:  A vicinity map showing the project location and its relationship to the levee, with distances to the levee crown centerline or levee toe and a levee station number nearest to the project.   Additional information such as latitude and longitude, river mile, street names, subdivision and lot number, etc. are important.  For projects adjacent or within the levee right-of-way, a plan and cross section view showing the existing conditions and required work are required.  The cross sectional view(s) must be taken perpendicular to the levee C/L and should include the entire levee in relationship to the project.   Also, copies of any special geotechnical work or reports that were completed for the project should be submitted.  Name and address of owner at location of proposed work.

C.          Scaled dimensioned drawings must be submitted with application showing all proposed construction work.  These drawings must be certified by a professional engineer registered in the State of Louisiana.


D.          Submit insurance certificate naming East Jefferson Levee District as additional insured.

E.           Applicant must warrant that the information submitted in the permit request is true and correct and will not change during the processing period.  Affirmation that the information is correct and agrees to comply with the “Terms and Conditions for the East Jefferson Levee District”.

F.           Commencement and termination dates of proposed activities.

G.          Complete drawings fully delineating the proposal to include:

1.  Plot plan, showing relationship to levee right-of-way, any fences, pools, separate garages, etc.  Show approximate distance from edge of pool to levee centerline.

2.  Survey plat of property and foundation layout.

3.  Means proposed for handling intercepted drainage (if applicable).

 

III.  General Permit Information:       

A.     Submit the original letter of request, formal application, insurance certificate, check and copies of all the maps, drawings, reports and plans to the East Jefferson Levee District.

B.     Corps of Engineers requires a copy of the levee permit application, letter of request, copies of maps, drawings, reports and plans must be submitted for their review and approval:  DO NOT submit insurance certificate or check:

C.     Department of Transportation and Development (DOTD) requires (1) copy for Residential Construction and (2) copies for Commercial Construction of the levee permit application, letter of request, copies of maps, drawings, reports and plans to be submitted to the following addresses, or emailed with an electronic version of the permit request.  DOTD also requires that the applicant provide half size plans (11x17), or smaller with the application.

D.     Mississippi River Levee:  No excavation may be performed when the Mississippi River attains or exceeds +11.0 ft. NGVD on the Carrollton Gage at New Orleans.  Information concerning current river stages may be obtained by calling (504) 862-2461.

E.     Permit Fee:

         Payable by check or money order to the East Jefferson Levee District.  Residential and Non-Commercial Construction is $150.00, Commercial Construction is $300.00.  Governmental bodies or agencies and non-profit charitable organizations may be exempt from this fee, but must obtain permits.

F.      Insurance requirements:

         An Insurance certificate naming East Jefferson Levee District as additional insured.  For projects with an estimated cost in excess of $500,000 applicants or their contractors are required to carry public liability insurance with limits of no less than $1,000,000 in a form and content acceptable to the Levee District.  Surety bonds or their equivalent may be required for long term facilities or activities.

G.     Processing time:

         The applicant should be aware that adequate review of permit request may take from four (4) to eight (8) weeks, depending on the nature of the request being reviewed at the time, and possible delays for modifications to the original proposal.  Therefore, providing complete and accurate information and clear drawings for the proposed project is important.

2008 CONSTRUCTION PERMIT APPLICATION


TERMS & CONDITIONS FOR

EAST JEFFERSON LEVEE DISTRICT

 

Unless expressly excluded in the permit issued to the Applicant, each permit automatically includes, but is not limited to the following conditions as if they were fully stated in the permit issued to the Applicant:

 

A.            A copy of the permit must be in the Applicant’s possession at all times, and available for viewing by the East Jefferson Levee District, the United States Army Corps of Engineers and the Department of Transportation and Development.

 

B.            The permit is transferable only with the signature of the new owner/operator in the space provided hereunder.  In order to validate this transfer, a copy of the permit shall then be forwarded to the East Jefferson Levee District Administrative Office.

 

C.            The Applicant will maintain the area from the land side toe of the levee to a point forty (40) feet from the water side toe of the levee, clean and free of any trash resulting from the Applicant’s activities.

 

D.            No pile driving/excavation may be performed when the Mississippi River attains or exceeds +11.0 ft. NGVD on the Carrollton Gage at New Orleans.  Information concerning current river stages may be obtained by calling (504) 862-2461.

 

E.             Applicant acknowledges that this Permit does not include any clearing or filling on the batture or flood side of the levee unless specified in the application.  If clearing or filling is not specified in the application a separate Construction Permit is required for these activities.

 

F.             Should Applicant for whatever reason cease to maintain operations, the applicant must obtain a modification of this permit which may require that any or all structures and materials in the area of operation shall be removed at the Applicant’s expense.

 

G.            Any damages to the area from the land side toe of the levee to a point (40) feet from the water side toe of the levee, if caused by the Applicant is to be repaired at the Applicant’s expense.

 

H.            Applicant agrees to hold harmless, indemnify, and defend the East Jefferson Levee District against any and all damages, which arises from the activities of the Owner, Applicant, or Tenants/Leasees.

 

I.              Should changes in the location or the section of the existing levee and/or waterway, or in the generally prevailing conditions in the vicinity, be required in the future, Applicant shall make any and all necessary changes to the permitted operation, including the removal of all structures and the cessation of all operations, all as may be necessary to satisfactorily meet the situation and Applicant shall bear the cost thereof.

 

J.             If applicant is an entity the signatory has full authority to bind the entity. 

 

K.            This permit is issued subject to the East Jefferson Levee District’s rights and authority granted by Louisiana law, particularly Louisiana Civil Code Article 665 and Louisiana Revised Statute 38:225 and Code of Federal Regulations, Title 33. Section 208.10. 

 

L.             The East Jefferson Levee District must maintain a clear and unobstructed right-of-way.  Any encroachments onto the levee district right-of-way must be removed at the applicant’s expense.
